Policy

1. Purpose

This Refund Policy outlines the circumstances under which refunds may or may not be issued by Express Specialty Pharmacy in compliance with applicable federal laws, Florida statutes, Florida Board of Pharmacy regulations, and patient safety standards governing prescription medications.

 

2. Prescription Medication Refunds

 

2.1 Non-Returnable Prescription Medications

In accordance with federal and Florida regulations governing prescription drug safety, Prescription medications may not be returned or refunded once they have been dispensed and leave the pharmacy’s control, except as permitted by law.

This includes, but is not limited to:

-Opened or unopened prescription medications

-Specialty medications

-Refrigerated or temperature-sensitive medications

-Controlled substances

-These restrictions exist to ensure patient safety and prevent medication adulteration or diversion.

 

3. Permitted Refund Circumstances

A refund or replacement may be considered only under the following circumstances:

 

3.1 Pharmacy Error

If an error occurs due to Express Specialty Pharmacy, including:

-Incorrect medication dispensed

-Incorrect strength or dosage

-Incorrect quantity

-Labeling error

The pharmacy will: Correct the error promptly, and provide a replacement or refund as required by law

Any incorrectly dispensed medication must be handled in compliance with pharmacy disposal regulations and may not be reused.

 

3.2 Damaged or Compromised Medication

If medication is damaged, compromised, or rendered unusable due to:

-Packaging failure before delivery, or

-Shipping issues attributable to the pharmacy

The issue must be reported within 24 hours of receipt. Replacement or refund will be determined on a case-by-case basis in compliance with regulatory requirements.

 

3.3 Shipping Errors

If an order is lost or delivered incorrectly due to pharmacy or carrier error, Express Specialty Pharmacy will investigate and may provide a replacement or refund when appropriate.

 

4. Non-Refundable Items

The following items are non-refundable unless otherwise required by law:

-Prescription medications dispensed correctly

-Medications no longer needed by the patient

-Medications affected by patient storage or handling

-Insurance copayments or deductibles already applied

-Medications refused after shipment or delivery attempt

 

5. Insurance-Related Refunds

Refunds related to insurance claims are subject to payer rules and coverage determinations. Any refunded amount will be adjusted in accordance with insurance reimbursement guidelines. Patients are responsible for any charges not covered by insurance.

 

6. Overpayments

In the event of an overpayment due to a billing or processing error, Express Specialty Pharmacy will issue a refund in compliance with applicable laws and payer requirements.

 

7. Refund Method

Approved refunds will be issued using the original form of payment whenever possible. Processing times may vary based on payment method and insurance involvement.

 

8. Patient Responsibilities

Patients are responsible for:

-Verifying prescription information at the time of pickup or delivery

-Reporting concerns promptly

-Proper storage and handling of medications once received

 

9. Policy Modifications

Express Specialty Pharmacy reserves the right to modify this Refund Policy at any time to remain compliant with changes in federal or Florida regulations.
